Stanford Legal Group Defends 'Expelled' Against Lawsuit

The Fair Use Project of Stanford Law School’s Center for Internet and Society announced Thursday that it would serve as legal counsel for the producers of “Expelled: No Intelligence Allowed” in their right to use a clip of John Lennon’s song “Imagine” in its pro-intelligent design documentary.

A lawsuit filed last week in a New York District Court by John Lennon’ sons and widow, Yoko Ono, alongside EMI Blackwood Music is seeking unspecified damages and a halt on all screenings of the film for what they claim is an illegal appropriation of the hit song.

The producers of the film, however, have claimed legal protection under the fair use doctrine – a position that was strengthened this week after the Fair Use Project announced it would defend the filmmakers in court.

In a statement Thursday, Anthony Falzone, executive director of the Fair Use Project, said that the case was a clear issue of free speech, given that the “Imagine” clip appears for less than 15-seconds and was used in a manner of artistic criticism to illustrate briefly a hypothetical world without religion.

“The right to quote from copyrighted works in order to criticize them and discuss the views they may represent lies at the heart of the fair use doctrine. These rights are under attack here, and we plan to defend them,” he said.

Logan Craft, chairman and executive producer of the film’s production company, explained the use of the clip while emphasizing the right to free speech.

“We included the ‘Imagine’ clip not only to illuminate Ben Stein (the star of the film)’s commentary but to criticize the ideas expressed in the song,” he said.

“Yoko Ono and the other plaintiffs are trying to redefine the Constitution and the free speech protection it affords. Our movie is about freedom—the freedom to discuss alternative views of how life began on our planet, the freedom to ask reasonable questions about the adequacy of Darwin’s theory, and the freedom to challenge an entrenched establishment,” he added. “Now we find that we also have to fight for our free speech rights.”

“Expelled: No Intelligence Allowed” is a feature-length documentary film about researchers, professors, and academics who claim to have been marginalized, silenced, or threatened with academic expulsion because of their challenges to some or all parts of Darwin’s theory of evolution.

Since its April 18 release, the film has attracted both praise and controversy in its challenge against Darwinism, while rising to become one of the most successful documentary films of all time.

Actually, Darwin said no such thing. If you're interested in the facts, you can go to http://en.wikipedia.org/wiki/Expelled_no_intelligence#Charles_Darwin_quotation_issue to see what Darwin *actually* said.

Please go read that section. It's rather shocking to see how the writers skipped over phrases and sentences in an attempt to distort Darwin's intent.

What were they thinking? Didn't they realize that people would double-check the facts and assertions of their "documentary"? If they thought that Darwin's actual words would indict him in the court of public opinion, why did they grossly distort them?

When it comes to the facts, this film is an embarrassment. With all due respect, I strongly suggest you double-check your facts before repeating anything that this film said.

Fair Use emphases the right to QUOTE from a work. If the producers of this movie wanted to critically discuss Lennon's lyrics, why didn't they simply DISPLAY THE WORDS on the screen?

Thou shall not steal. The producers of this film could have easily shown Lennon's words without stealing his music and voice. They *wanted* to get sued to gin up some publicity, and they deserve to lose the lawsuit.

The popularity of the film cannot be taken in a vacuum. You must take the amount of $$$$ spent for publicity of the film; these people used plenty. They hired FOUR SEPARATE FIRMS to help market the film. They took the movie on a national tour to drum up publicity. They even paid churches to bring children and adults to the movie. All of these are documented in the Wikipedia entry for the film.

Speaking of the WIkipedia entry: the facts are clear. NONE of the five "expelled" were actually expelled. Most egregious is the person that the "documentary" claimed was "fired" from the Smithsonian. Guess what: HE NEVER EVER WORKED THERE! NEVER!

For a movie claiming to be a documentary, this movie has made fundamental factual errors on each of those five so-called expelled people. That's the most basic thing that someone should do in a documentary: get the facts right.

Doesn't the Bible say something along the lines of "thou shall not bear false witness"?

I challenge anyone out there: tell me which of the stories of the five "expelled" is even remotely accurate. Since the filmmakers failed to provide a companion webpage with the facts, I suggest you start looking at http://en.wikipedia.org/wiki/Expelled_no_intelligence .

Will anyone take the challenge?

It has been in Tulsa, OK since it opened 4/18. I went a week later and it had a respectible crowd considering (1) it is a documentary, not a Hollywood production, (2) an independently produced file and (3) one dealing with science.

I just checked MovieTickets.com and it is still showing in all the theaters that it opened at on 4/18. Maybe it depends on the part of the country. Alternative/controversial films tend to do well here. I had not heard which theaters were showing the movie but I was able to guess two of them:)

Where? It played briefly at a mere handful of theaters in the metropolitan area for a week and has now disappeared.
