The New York Court of Appeals has upheld a ruling that mandated the state to recognize all same-sex marriages performed outside its borders.
The new measure became law after the court declined to hear arguments concerning the appeal of the decision by a State Supreme Court in February that recognized full marriage benefits of two state community college employees who legally married in Canada.
The February ruling, which threw out the State Supreme Courts 2006 decision that state law "currently defines marriage as limited to the union of one man and one woman," argued that same-sex marriages performed legally in other states or countries be allowed barring legislation that would specifically prohibit it.
Alan Van Capelle, executive director of Empire State Pride Agenda, said the recent ruling was progressive and a step toward the goal of giving same-sex couples full marriage benefits.
"Despite today's good news, the state of marriage for same-sex couples in New York is still unsettled," he said, according to LifeSiteNews.com
"Until a law is passed by the New York State Legislature, there will always be the possibility that another court decision could undo [this ruling] and strip away from otherwise legally married same-sex couples all of the 1,324 state-based rights and responsibilities that come with a marriage license in New York, he added.
Currently, although Massachusetts is the only state to recognize same-sex marriage, several other states, including New York, recognize same-sex unions or marriages performed in other states or countries.
Since 2004, when the Massachusetts State Supreme Court made its ruling to recognize gay marriage, 26 states have passed a constitutional ban on the practice, while over a dozen others have passed laws limiting or outlawing it.

sinful and immoral in YOUR opinion. Do you not understand that 1. not all Americans, nor the whole world, are Christians and 2. the law does not, and should not, reflect any religion. Therefore, the court made the right decision. Legally and politically. On account of ethics, well that's something I guess everyone has their own opinion about.
Now concerning the things whereof ye wrote unto me: It is good for a man not to touch a woman. Nevertheless, to avoid fornication, let EVERY man have his own wife, and let EVERY woman have her own husband (1Co 7:1, 2).
The word of God clearly instructs man that there are only two ways to avoid fornication:
1. Touch not a woman
or
2. Have a wife (woman).
Such guidance is for EVERY man. Scripture does not instruct some men to have a wife and some men to have a husband or life-long male partner to avoid fornication.

Or perhaps, Jar, they decided that gay marriage is in no way detrimental, and therefore is allowable. Heroin use is detrimental, hence why it isn't legal.
Using the logic of this current decision then were a country that legalized heroine use and possession, that person should be able to come into the U.S. with any amount of the drug for use.
DannyPoo - The US (and hences the states in the US) has always recognized marriages from other countries. Lots of folks get married in the Caribean (two of my best friends included) and the Michigan recognized their marriage.
The NY Court of Appeals did not base their refusal to hear an appeal on any NYS law; rather, it was merely their interpretation of what the NYS laws should be. They were creating NY State law, not interpreting any specific laws on the books. As a matter of fact, they are actually contradicting their own prior ruling, recognizing marriage as between a man and a woman. If anything, the NY Ct. of Appeals is engaging illogical legal reasoning.
Stephen Hayford, spokesman for the Coalition to Save Marriage in New
York, said the court's decision poses huge problems.
"Canada has decided to pass a same-sex 'marriage' law; New York state
has not," he said. "It's not appropriate for Canada or anyone else
to export same-sex 'marriage' into New York and force New York
employers to recognize something that our state Legislature and our
elected officials have not chosen to legalize."
Bruce Hausknecht, judicial analyst for Focus on the Family Action, said
the court, which ruled in favor of traditional marriage two years ago,
is contradicting itself.
"Inexplicably, the high court is letting stand a ruling that says that
New York essentially has no public policy regarding same-sex
'marriages' performed elsewhere," he said. "It's ridiculous legal
reasoning to insist that a state could recognize a type of 'marriage'
from outside that it will not permit within the state. Yet that's
exactly what the Court of Appeals has now done."

So according to this Judge, if an Iranian comes to America and converts to another Religion, we should uphold the laws of Iran and punish that individual.
