Boy Threatened by School Officials over Anti-Abortion Shirts

A Christian legal group is suing a middle school in Hutchinson, Minn., in federal court over the right of a 12-year-old boy to wear pro-life t-shirts in school.

The boy, referenced in the lawsuit only as “K. B.,” was reportedly and repeatedly harassed, ostracized, publicly ridiculed, and threatened with disciplinary action by school officials because he wore t-shirts produced by the American Life League as part of their anti-abortion awareness campaign.

The t-shirts displayed images of unborn babies accompanied with such messages as, "Abortion: Growing, Growing, Gone,” "What part of abortion don't you understand?" and "Never Known – Not Forgotten" alongside “47,000,000 babies aborted 1973-2008" printed on the back.

Richard Thompson, president and chief counsel of the Thomas More Law Center (TMLC), said that the case was a clear issue of viewpoint discrimination. Hutchinson Middle School officials were clearly in the wrong, he said.

“This courageous young Christian was ridiculed and threatened by teachers for expressing his deeply held beliefs. These school officials clearly violated the U. S. Constitution and the school’s own written Dress Policy which specifically states it is not intended to abridge the rights of students to express political or religious messages,” he explained in a statement.

Although the school lists as its policy that students with “inappropriate” clothing deemed disruptive to "the educational process” may be sent home, TMLC attorney Brandon Bolling noted that the young student was never asked to do this.

“The Supreme Court has held it permissible for public schools to limit student speech only when there is an actual and substantial disruption of school activity,” he said.

“That is not the case here. The only people who took issue with the pro-life t-shirts were the school’s employees – in fact, if any one caused any disruption, it was the school’s employees, by their constant public harassment of our client because they disagreed with his pro-life message,” he added.

The boy’s mother told the local St. Paul Pioneer Press that she hopes the case will help rectify the unjust treatment of her son.

"My son kept getting singled out," she said. "He should be able to wear those shirts at school, and they decided that he can't. It's not right," she said.

"He knows [abortion] is the termination of life. He knows that it's wrong,” she added. “Even if he's the only person at the school who believes that, he should still be able to wear that shirt under the Constitution, and they've taken that away from him.”

    As a public school principal I must say that to my personal knowledge there are regular and explicit information sent to principals and other school officials from a wide variety of sources that provide sound and helpful guidance on this issue. Such guidance if followed would have prevented this kind of viewpoint discrimination. Even the most casual reading of the landmark Tinker case would have made this obvious to any school official. It was not only the duty of the school to refrain from discriminating but also to take reasonable steps to protect the student from harassment. In my school many students where a wide variety of competing political and religious oriented images and messages within their clothing. Their right to do so is actively protected. In fact this policy not only does not result in a disruption of the educational process instead it enriches the learning environment by serving as a living demonstration of the principles of free expression, tolerance, diversity in the marketplace of ideas that make our country great.

    It would seem that the purveyors of "tolerance" have taught their pupils quite well. The students were apparently tolerating this boy's apparel. It was only the teachers and administration that were freaking out. tsk tsk - so intolerant.

    Raised huh, as in they are all already adults and graduated from such public schools. And, how are they fairing in life so far? By your sentiments alone it’s as if by going to a public school you think the kids will be unable to cope with today’s world, so I ask how are they doing?

    Surely if they are doing well you will write off the public schools efforts in getting them ready, and no doubt if they are not all performing up to your or national standards, you like most wont find fault within yourself for their upbringing but will instead point fingers to the school in which they were raised. Talk about trying to have it all your own way…

    Now, if the kids whom I suspect are now adults are doing just fine, surely you wont give any credit towards such public schools would you? And then there’s the issues of ‘godlessness’ in public schools, as if this is something not found in any other countries globally. Let’s not talk about what the US constitution declares regarding separation of institutions of power, that would after all explain why public schools aren’t allowed to indoctrination centers like the Islamic madrassas are in the Muslim world

    Certain things regarding 'free speech' aren’t protected under it. After all, even on this very board such things at hate speech and the like aren’t to be tolerated and not protected under the free speech clause. Also not protected under the free speech rules is what is tolerable and germane in schools and anything which is overly divisive, inflammatory or can disrupt the process of actually learning is also NOT permitted and not protected. This same rule applied to how teenagers aren’t under free speech rules allowed to disrupt classes by waving the confederate flag around as it obviously holds deep roots in bigotry segregation and hatred.

    A picture of an unborn child is gruesome....hmmmm. A shirt that states a statistic is gruesome..hmmmm.
    A shirt from a rock back showing explicit and evil demonic pictures is acceptable.
    Makes me wonder about your twisted sense of morality. And its sad that the people who share your "moral" views have sunk our country into a cess pool.

    Why is that when we hear about Christian student's beliefs being singled out in a public school that people aways start talking about leaving the godless public schools. Of course they are godless! Of course they are of this world! But aren't we as believers, including our children, called to be lights in the darkness. Jesus called us to be in the world but not of it. He did not say be ye separate.

    We raised all three of our boys in "godless public schools" where they had to learn to stand up for their faith with other students, with teachers and even school administrators.

    Now their faith is able to thrive in the midst of godless state universities, the godless business world & the godless military. We didn't keep our children in the spiritual "shallow end of the pool" but they learned to swim spiritually in the "deep end."

    I'm sorry, but anyone would would wear gruesome images such as this SHOULD be disciplined. It is as simple as that! this is a school, NOT a freedom march. It is one thing to spread your social beliefs, but it doesn't make it ok for me to have two men or two women having sex on my shirt and declaring MARRIAGE FOR ALL!.

    chicago24, I do appreciate your concern for this child, so then am I to assume you will be petitioning your local school board to implement and enforce parent consent guidelines that will keep parents informed when their child will be exposed to issues such as the promotion of the homosexual agenda or the availability of free birth control information and products that now they can get without the consent or permission of their parents as well as parent consent requirements that would require a girl to get the permission of her parents before she could get an abortion?

    Yes, anyone has a right to express their beliefs but there's a thing called "being prudent." I would not let my 12 year old wear a politically charged T-shirt of ANY kind. He is a CHILD. And children are not equipped to handle the possible ridicule, nor should they EVER be put in a position to have to do so.
    I'm sorry if my caring about the well-being of a child is offensive to any of you.

    I sure this story would have had a different spin if the child were wearing a shirt promoting gay issues, Islam, paganism or any topic but a Christian one. The public or at least media outcry would have been deafening in such cases. I also wonder if the school should check their staff a little more thoroughly Apparently he is only safe among his peers and none of the staff are willing to stop this harrassment. Perhaps it should be labelled bullying, as it is such a hot topic that the school might have to deal with it.

    Perhaps there is wisdom in school uniforms afterall. Then all they could argue about is the color and style.

    With that said, it is quite normal for the educational establishment to pick on what it doesn't believe in. Those who disagree with evolution are 'stupid'. Those who believe students should remain pure until marriage are "prudes". Here in Furman territory, it's OK to be rude to the President of the United States just because you disagree with him. We have little respect for anything we don't agree with. (Just FYI, a friend of mine was at the graduation and the people in the white shirts that said "I Object" were NOT there during the graduation itself. The footage was taken before or after the graduation itself. Cameras never lie but edits often do....)

    It is never time for Christians to run from the battle. It is time to teach our children how to be Christian in a non-Christian world. The public schools ARE the mission field and Christian children are the missionaries.

    It is past time for Christian parents to find or create great Christian schools for their children to attend. Abortion is not the only issue for which Christian students are readily ridiculed in government schools.

    The school officials did the harassing, pretty bad. but it seems to be all to common. same games as satan. Things that make you go hmmmmmmmm.

Either you are a person who advocates the killing of persons (babies, young people or the elderly), are so stupid you do not understand that Christian clean young people have the right to express their beliefs as openly as the filthy worldly rap singers do, or you are only here to stir up trouble and get adverse reactions.     chicago24, so 12 year olds are mature enough to get free birth control without their parents consent and if they were a girl she could quite possibly get an abortion without the consent of her parents but 12 year olds aren't mature enough to decide to wear a pro-life T-shirt to school and so the parents are to blame.

    Obviously, the point that Chicago24 is trying to make is that pro-abortion people are assumed to not be capable of controlling themselves and are likely to react violently to a seeing a message with which they disagree. Therefore, the logic is, if a rabid pro-abortion person physically attacks you for voicing (or in this case, displaying) your opinion, it's your own fault - you should have known that they would be incapable of self control.
    By that logic - yes, allowing the boy to go to school wearing such a shirt would be placing him in a dangerous situation.

    However, that being said in jest - the sad part is that Mr. Chicago is nodding his head in complete agreement.

    Chicago24, do you personally know this family? How do you know his parents made him wear these shirts? Children often see the realities of the evils of abortion much easier then many adults do in this day and age. Children see the mindset of this "culture of death" and realize that it could just as easily been them that was killed by the abortionist. Congratulations to this young man who has the courage to vocally make a moral stand for his deceased friends who should be with him in that school yard playground. AMEN!

    WOW, this young man is courageous, maybe we adults can learn lessons and speak out against abortion in our workplaces and in front of abortion clinics. Let’s support him morally, let’s support him in our prayers so that he may endure. Let’s support him by writing letters and email to chastise the “hardened” officials at that school.

    SHAME ON THE PARENTS for letting their CHILD wear clothing to school that addresses such a sensational and potentially explosive issue!! His parents were putting his safety at risk by letting him (or more likely, encouraging him) to do that.
    His parents actions should be reported to Child Protective Services for putting his safety in jeopardy. There's a time and a place for expressing one's opinions on abortion. Certainly not on the clothing of a twelve year old!
