Calif. High Court Dismisses Suit Against Marriage Amendment

The California Supreme Court unanimously dismissed efforts to throw the California Marriage Protection Act off of the November ballot Wednesday, giving Californians the chance to consider a constitutional amendment that would limit marriage to a union between a man and a woman.

The court did not give a reason for deciding not to accept the case, which gay “marriage” supporters placed before them last month in a bid to prohibit the public from having the opportunity to vote on the issue this fall.

The “huge victory” in the fight to protect marriage was lauded by conservatives and pro-family activists in California and throughout the nation.

"This was a frivolous lawsuit. It was a desperate attempt to try to keep the voter initiative off the ballot in November," said Glen Lavy, an attorney with the Alliance Defense Fund representing the measure's sponsors, according to The Associated Press.

"The Court’s dismissal sends a strong message that Proposition 8 continues to have the law on its side,” expressed Ron Prentice, chairman of the Protect Marriage initiative, in a released statement. “Time and time again, the opponents have attempted to circumvent the democratic process, but the fact remains that the people of California have a right to vote on this issue."

In 2000, more than 61 percent of California voters overwhelmingly supported Proposition 22, which upheld the definition of marriage as being between one man and one woman. This past May, however, the California Supreme Court overthrew the vote of the people, ruling 4-3 to strike down Proposition 22 and related California laws and to allow same-sex couples to “marry.”

In response, pro-family activists have been mobilizing California voters to support Proposition 8, which qualified for the November ballot two weeks after the California High Court’s infamous decision to legalize same-sex “marriage” in the state.

If approved by a majority of voters on Nov. 4, the amendment would overturn the California Supreme Court ruling, leaving Massachusetts once again as the only state that legalizes same-sex “marriage.”

Since 2004, when the Massachusetts State Supreme Court made its ruling to recognize gay “marriage,” 26 states have passed a constitutional ban on the practice, while over a dozen others have passed laws limiting or outlawing it.

    The California that makes the news all the time is not the real California. There are vast, rural, conservative expanses of that state. Conservative they are, but Californians are an independent-minded, live-and-let-live group. Most of them think that their neighbors' business is, after all, their neighbors' business. They are correct.

    I will be real surprised if that proposition is not defeated. But even if the people vote it in, it will only be temporary. The generation coming up behind these voters will not stand for discrimination.

    To Mike2685,

    It seems that you may not be familiar with the biblical concepts of authentic Christian discipleship as taught in the Bible.

    To follow Jesus at any cost cannot be compared with a Muslim terrorist who desires to kill at any cost.

    The Christian is a slave to Christ out of love for Him. A true believer is motivated by love and serves his neighbors.

    The Muslim terrorist, on the other hand, is motivated to kill out of hate. There is no compassion, no mercy, no grace, & no love.

    In other words, the concepts of "at any cost" are placed in very different socio-religious contexts that cannot be rationally equated on fair grounds. Any attempts to do so merely will reveal an inadequate grasp of orthodox biblical teachings.

    I hope that this helps to clarify and distinguish between the two examples.

    Some of them are clearly liberal. One was even appointed for a federal stint by Clinton. Some are less easy.

    Still, it would have been nothing short of thumbing their nose at the Constitution and Judicial process for them to have stood in the way of the voters. It would have been just plain dumb for them to have stood in the way.

    The voters will have the final say, *again*. And the all these faux marriages will be nullified by law. God works in mysterious ways. The gay lobby isn't going to win this one, the people are. America will never accept deviancy of this kind as being equal to marriage between man and woman.

    Let's pray for all these Californians and pray that ALL CHRISTIANS and people of Good will who know the Truth about marriage will defeat Gay Marriage.

    The Holy Word of God is clear about homosexual activity being disorded, sinful and against the will of God.

    Today, everything is getting redefined. Moral and theological relativism is everywhere. We must defeat these secular relativists! God will not bless the USA if we go so far against His will.

    Does anyone here know the make-up of the CA supreme court? Isn't it mostly conservatives - or Republican appointees, anyway? Some of these judges must have acted aqainst their own personal views when they voted to make discrimination illegal.

    How should I say this? I am pro-same-sex marriage, but it would have been a serious blow to democracy if the California court had taken up such a lawsuit. I agree that it was "frivolous." I disagree that this is a "huge victory" for the other side. This weird episode in American culture is like a soap opera sometimes. Both sides can be so venal.

The republicans must have bribed the judges to go against whatt California originally voted for just so they have a better chance this election. No doubt it helps them, but that is a coincidence.
