Senator Suing God Urges Judge to Proceed

By Associated Press Writer|Josh Funk

OMAHA, Neb. (AP) - State Sen. Ernie Chambers says his lawsuit against God might seem funny but that doesn't mean it doesn't have a serious point.

Nebraska state Senator Ernie Chambers of Omaha speaks to reporters outside Douglas County District Court, in Omaha, Neb., Tuesday, Aug. 5, 2008. Chambers acknowledged that he used wit and humor in the lawsuit he filed last September seeking a permanent injunction against God. Chambers said God has made terroristic threats against the senator and his constituents in Omaha, inspired fear and caused ''widespread death, destruction and terrorization of millions upon millions of the Earth's inhabitants.''

Chambers asked Douglas County District Judge Marlon Polk on Tuesday to let his lawsuit proceed. Chambers said he wants to make the point that everyone should have access to the courts regardless of whether they are poor or have the means of billionaire Warren Buffett of Omaha.

"What brought me to the point of filing this lawsuit was the ill-advised attempts by certain legislators to prevent the filing of certain lawsuits," Chambers said.

Polk said he would consider the issue and rule later.

Chambers acknowledges using wit and humor in the lawsuit he filed last September seeking a permanent injunction against God. Chambers said God has made terroristic threats against the senator and his constituents in Omaha, inspired fear and caused "widespread death, destruction and terrorization of millions upon millions of the Earth's inhabitants."

The court told Chambers last week that his lawsuit may be dismissed because he had failed to serve notice on God. Chambers acknowledged that failure in court Tuesday while sitting a few feet away from an empty table reserved for God and God's attorney.

"Despite my most sincere, zealous efforts, I could not find a location to serve the defendant," Chambers said.

But Chambers asked Polk to take official notice of God, and the Almighty's omniscience and omnipresence.

Chambers argued that courts and the U.S. government already routinely take notice of God. Courts swear in witnesses with an oath that includes the phrase "so help me God." Plus, the pledge of allegiance describes "one nation, under God," and U.S. currency proclaims "In God We Trust."

And the senator said that if the court recognizes God, the deity wouldn't need formal notice of the lawsuit because he knows everything. And God would be at every hearing because he's everywhere always.

A senator for 38 years, Chambers skips morning prayers during the legislative session and often criticizes Christians. He is being pushed out of the Legislature by term limits.

Chambers said he appreciates the difficult position Judge Polk is in because of the unique nature of the case, but he hopes the lawsuit will be allowed to proceed.

"Your honor, I do not envy your position," Chambers said.

    Ethan,
If you read the original letter written by Thomas Jefferson to the church, you'll find what he meant by separation of church and state. He stated the church should have say in government matters, but the state should not have say in church matters. This was to protect religious freedoms, the reason this country was established. Just as most laws are misinterpreted, so was this letter written by Thomas Jefferson.

This article doesn't say that Senator Chambers doesn't believe in God (an atheist) but a WorldNetDaily article does.

"Chambers, an atheist, requested that the court acknowledge the presence of God in the courtroom so he wouldn't be required to "serve notice" of the trial, according to the Omaha World-Herald."

Where did it say in the article that Chambers doesn't believe in God? Why aren't the good Christians not commenting on the reason why Chambers felt the need to use a stunt to bring an issue out. Access to the courts by all people as the U. S. Constitution guarantees. Worry about the frivolous laws suit brought on by corporations that cost us all.

The man does have a serious point. The US legal system is absolutely FULL of references to "God" and yet there's meant to be a separation of church and state, he's exposing the hypocrisy of such a system.

We have guys like this as senators??? No wonder our country is where it is!

Senator Chambers says he wants to sue a God he says doesn't exist. Doesn't make any sense to me.

This guy is a fruitcake. I think the judge should order a psychriatric evaluation of the man. If he is found compentent then the judge should fine him for filing a frivolous lawsuit and wasting the court's time. If he is incompentant then he should be lock away in a mental hospital or ordered to receive psychriatric help.

At the very least Senator Chambers lacks sound judgement. Perhaps the senate should impeach him, or the voters should vote him out of office.

Ok, so he wanted to prove a point. Now why are you still wasting the courts time? You've made your point. They even gave you a court appearance.

My mom said this a long time. Somebody is always watching you. The bible says it also. Wherefore seeing we are surrounded by so great a could of witnesses...
    People are watching this case.

In this man's mind, the lawsuit has nothing to do with God. This guy is just showboating his athiestic principles to prove his point ... of which I partially agree with; everyone should have the same access to the courts, but let's not hog the system at everyone else's expense.

So when he loses, I sure hope he sues the judge for throwing out his case. And I hope he sues everyone in the courtroom for snickering. He should also sue anyone who publically disagreed with him ... or agreed with him,
cuz by golly, we should all have the right to endlessly bog down the court system with frivolous cases that waste the court's time and tax payer's money.

On a non-sarcastic note ... we should pray for this man.

Question is...which God is he suing? The God of Christianity? Islam? Hinduism?

Also, he is taking his cues from the movie that released in 2001?

I'm all for it! After all, no matter the verdict it would set the precident that God indeed exists! I doubt, however, they could prove any of this is God's fault. The burden of proof would rest with the plaintiff.
