High Court Justice Says Right to Abortion Nowhere in Constitution

During a visit to law students at Roger Williams University this week, Supreme Court Justice Antonin Scalia said that the right to an abortion exists no where in the constitution.

    "accept this country is so criminalization ridden, i hate the idea of creating one more set of laws for throwing a whole new group of people into prison....
    I hate the idea of reinterpreting murder for "pro-choice"
    are you saying there is nothing in the new testament to justify your position?...you have no knowledge of God in you do you?....the law was a divine ordinance given by God himself, God is the same yesterday today and forever,....besides what happens if you take a bald eagle egg and crush it? Wouldn't that be a crime punishiable by federal law? Is the stupid bird more important than a human being?

    i dont think anyone would disagree that killing a viable fetus should constitute murder, but that doest address the first and second trimester. or the first and half of the second trimester. maybe when the fetus grows to a certain stage of developement , abortion will be ruled out as a possiblity accept for the health of the mother. before this happens there will have be federal laws that hold expectant mothers accountable for choices made while carrying a fetus in the 3rd semester.

    accept this country is so criminalization ridden, i hate the idea of creating one more set of laws for throwing a whole new group of people into prison.

    however the day is coming, because of finite resources of this planet, that govts will be forced to use all sorts of contraceptive methods to control population growth within their boundries.

    i cant imagine what additional problems china would have now, if they hadnt been using the stringent population controls they have been using since mao.

    i thought you had something to say........................................what is the connection to your scriptures and what you are applying them to. even exodus 21 is about men who are fighting. you give the appearance of crediting yourself with the license to kill those who either get abortions or give abortions.

    if your understanding of justice lies in the old testament then wouldn't one be justified in killing anyone who cursed their parents, or wouldn't slavery still be a justifiable mechanism for the distribution of wealth and power.

    consider what hebrews says about the old covenant.

    are you saying there is nothing in the new testament to justify your position?

    CP2008-- no u r completely wrong, Scalia clearly states "The constitution is neither a liberal or conservative document, and is only meant to be interpreted as the original founding fathers intended," even a 10 year old can read and understand that. therefore, the constitution doesnt address abortion, the founding fathers had no idea what it was

    would not this whole issue be solved if we had a perfect contraceptive that could administered perfectly?

    While using the hot button issue of abortion as a vehicle, I believe the justice's point is exemplified by the fiollowing quotes:

    "Scalia pointed out that the Senate, which confirmed him by a vote of 98-0 in 1986, would have difficulty confirming him today because constitutional “originalists” like himself were increasingly being abandoned in favor of justices who prescribe to single ideologies.

    “The most important thing is whether this person will write the new constitution that you like,” he said, decrying the current confirmation process of Supreme Court justices."

    If you think about it, it's scary.

    SCALIA IS 100%, ABSOLUTELY WRONG!

    Our constitution clearly says in the Preamble:

    We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our POSTERITY, do ordain and establish this Constitution for the United States of America.

    This Preamble to our Constitution says that the rights that these men fought and died for were for them (the signers) and their POSTERITY- their YET UNBORN CHILDREN.

    In the Declaration of Independence our founders put forth the bedrock principles by which this great country would be governed:

    …We hold these Truths to be SELF EVIDENT, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are LIFE, Liberty and the Pursuit of Happiness…

    All citizens of the United States have the right to LIFE, Liberty and the Pursuit of Happiness. They (the founders) plainly stated that this right is for us (the signers) and our posterity (unborn children), you and me!

    This Roe v Wade ruling was UNCONTIUTIONAL because it denies our youngest citizens their CONSTITUTIONAL RIGHT TO LIFE!

    On balance Mr. Scalia may be a good Supreme Court Justice. But on this issue he is absolutely wrong. And what a shame. Even a 13 year old can read the Constitution and understand it...
