That the Supreme Court rejected this appeal is encouraging and bodes well for marriage equality for Gay Americans. Maybe the justices are coming to the realization that you just can't put the rights of the minority to a popular vote, and that popularity and constitutionality are not synonymous. That the Supreme Court rejected this appeal is encouraging and bodes well for marriage equality for Gay Americans. Maybe the justices are coming to the realization that you just can't put the rights of the minority to a popular vote, and that popularity and constitutionality are not synonymous.
I'm certain that the Supreme Court would prefer NOT to have to deal with this issue, but they WILL have to deal with it sooner or later. And the fact remains that there is simply no purely Constitutional argument to be made for denying law-abiding, taxpaying Gay couples the exact same legal benefits that Straight couples have always taken for granted. Call it a "civil union" if you like, just as long as Gay and Straight couples are treated equally under the law.less

OK, fine. Let's suppose there's either a Supreme Court decision or a Constitutional amendment saying that Straight (i.e. heterosexual) couples can get "married," and Gay couples can have "civil unions," but otherwise all the legal benefits would be the same at all levels of government. This would seemingly meet the requirement of equal protection as guaranteed by the 14th Amendment.
You claim only 34% of American support Gay marriage. How many Americans would support the alternative arrangement that I have outlined above? I suppose MOST Americans would. Could you? The "Founding Fathers" sought independence from England for various political and economic reasons, little of which had to do with the Church of England. The earlier colonist came to America for a variety of reasons, part of which had to do with religious persecution. But the civil government of Canada is not persecuting anyone. Churches are being left alone, people can worship as they want to. But that doesn't mean a taxpayer-funded employee has the right to refuse to fulfill his job responsibilities because he has religious objections to his customers.less
