Anti-DUI Lawyer David Maloney's Image Marred by Drunk Driving Arrest
David Maloney, a lawyer from Florida who has now become infamous for his anti-DUI commercials, was arrested Sunday morning on suspicion of driving under the influence. The arresting officer reported that the 49-year-old personal injury attorney refused to take field sobriety or Intoxilyzer breath tests.
According to Escambia County Jail records, Maloney was arrested on Mother's Day at around 3:35 a.m. An Escambia County sheriff's deputy pulled over a 2005 black Lamborghini that was speeding at 55 mph in a 35 mph zone in the 1600 block of Via de Luna. The area is near the Lago Bonito townhomes in Pensacola Beach, Florida. The officer later identified the driver as Maloney.
Maloney denied having drank anything and said he was on his way home after "helping out" at a celebration for the Pensacola Ice Flyers, of which he is a minority owner, according to AL.com. The team bagged the President's Cup after winning the Southern Professional Hockey League on Thursday. Maloney further explained that he needed to get home to relieve his babysitter and refused to undergo the field sobriety exercise prior to the arrest.

"Let me ask you a question? Keep me cuffed if you want to," Maloney said to the officer, as reported in the police report. "Can we go sit over there and try to figure this out?"
Maloney was transported to the Escambia County Jail where the officer requested for his breath sample. However, the lawyer declined to take the Intoxilyzer test as well.
The lawyer is a partner in the Maloney & Frost law firm and has appeared in commercials expressing his stance against representing drunk drivers. These advertisements have been described as "overly dramatic" and sometimes "humorous" and now puts him in a hypocritical light.
Maloney was released shortly before 10 a.m., about eight hours after the arrest, after paying a $500 bond. His court date is on June 1, 2016.
