Penske Sons Arrested and Charged with Breaking and Entering

Two sons of famed race car owner Roger Penske were arrested after they broke in to the Nantucket Yacht Club in Massachusetts.

Jay Penske, 33, who owns the IndyCar racing team Dragon Racing, and his brother Mark Penske, 35, were arrested early Thursday morning, as reported by The Inquirer.

According to reports, the incident occurred after the two brothers were urinating in the parking lot of the yacht club and were approached by two women.

When one of the women confronted Jay he "turned and continued to urinate on her boots," according to the police report. "He then proceeded to grab her arm and push her. (The woman) also states that Mark before he ran away pushed her and they both then ran to the house on Yacht Club property."

Police were first contacted after the incident and handled that case as assault and battery after the two women flagged down a police officer sitting and said they had been assaulted.

Local reports indicate that Jay Penske was arrested as he was running away from the club and they found his brother in an employee staircase in which he had fallen down.

"There were three people living in the apartment and only two saw the suspects enter the house and they got startled when they were confronted," according to the report.

The women did not press assault and battery charges, according to the report written by officer John Muhr of the Nantucket Police Department.

The Penske brothers, who are not members of the Nantucket Yacht Club, reportedly spent the night in the Nantucket Police Department's detention center and were arraigned Thursday morning.

The brothers were charged with breaking and entering in the nighttime with intent to commit a misdemeanor.

Both were released on their own recognizance with a hearing scheduled for Aug. 20.
