Trump has threatened to sue Bill Maher over an ape joke the comedian and host made last year on "The Tonight Show With Jay Leno" Donald Trump claims that the comedian owes him $5 million.

Trump's threat to sue Maher came Monday, when the business mogul appeared on "Fox & Friends." It was then that he informed co-hosts and audiences that he hadn't forgotten about Maher's joke- the comedian said he'd give Trump $5 million if he proved he wasn't "the spawn of his mother having sex with an orangutan." Trump mailed Maher his birth certificate, but received no money.

"Today I sue Bill Maher," Trump called in to announce on "Fox and Friends." He claimed that the documents were filed in Los Angeles County Superior court, citing breach of contract.

"He promised me $5 million for charity if I provided certain information," Trump said, despite protests from the Fox show hosts that Maher was joking. "Well I provided the information, he didn't pay," said the mogul, adding that the comedian said his joke "with venom."

Maher's orangutan joke came as a response to Trump's October "announcement" that he claimed would change the election. The former Presidential candidate revealed on his Facebook page that he wanted President Obama to release his college records and other points of identification.

"If Barack Obama opens up and gives his college records and applications and if he gives his passport applications and records, I will give to a charity of his choice-inner-city children in Chicago, American Cancer Society, AIDS research, anything he wants-a check immediately for $5 million," Trump said in a video.

While Barack Obama joked about the matter- Trump didn't like him since the two "were growing up in Kenya," he said on "The Tonight Show"- Maher seems to be taking Trump even less seriously.

"What?? Really? Hahahahaha," Maher tweeted. The business tycoon doesn't seem like he will be dissuaded, however.

"I don't think he was joking," said Trump. "It was a pathetic delivery, but he said, 'I will give' and I said I will accept, so let's see what happens."
