Conservative Organization ALEC Threatens Legal Action Against Groups Accusing It of Denying Climate Change

Reacting to more than 100 companies that have reportedly left the organization because of what it sees as misleading information, conservative policy group, the American Legislative Exchange Council, has reportedly threatened legal action against several activist groups accusing it of denying climate change.

Following the departure of big companies like Google from the group last fall and most recently BP in March, lawyers for ALEC sent "cease and desist" letters to Common Cause and the League of Conservation Voters asking them to "cease making false statements" and "remove all false or misleading material" suggesting that ALEC does not believe in global warming immediately.

On its website, ALEC says it "works to advance limited government, free markets and federalism at the state level through a nonpartisan public-private partnership of America's state legislators, members of the private sector and the general public."

In the letter to Common Cause's President Miles Rapoport, ALEC's lawyers noted: "ALEC's position is clear. ALEC does not deny climate change … Alec has recognized the fact that '[h]uman activity has and will continue to alter the atmosphere of the planet' and that '[s]uch activity may lead to demonstrable changes in climate, including a warming of the planetary mean temperature.' The model policy was approved by the ALEC Board of Directors in 1998 and is the standing model policy on climate change."

The letter goes on to warn Common Cause against continuing to promote misleading information about "ALEC's extreme agenda, including the denial of climate change" and promising legal consequences if the demands of the letter are not met.

"We demand that you cease making inaccurate statements regarding ALEC, and immediately remove all false or misleading material from the Common Cause, and related, websites within five business days. Should you not do so, and /or continue to publish any defamatory statements, we will consider any and all necessary legal action to protect ALEC," it continued.

In a release issued Sunday by Common Cause, however, Rapoport said his organization has no plans to stop their lobbying efforts.

"ALEC's demands and legal threats are an effort to shut down debate about its policies and matters of national importance. They seek to chill our right to advocate for the public interest," said Miles Rapoport, President of Common Cause. "It won't work."
