Mindy McCready: 'I Did Not Kidnap Missing Son' (VIDEO)

Country music star Mindy McCready has said she and her 5-year-old son are not missing and that she is trying to get the situation "straightened out."

McCready does not have legal custody of her son, Zander, but does have visitation rights. The two were last seen Tuesday Night when McCready took her son from her father's home on Cape Coral, Fla. McCready's mother has custody over the child.

Police filed a missing persons report on Tuesday night. A judge ordered her to return Zander by 5 p.m. Thursday, according to AP.

“I am working with lawyers to try to get all this straightened out,” said McCready to Access Hollywood on Wednesday.

“I did not steal my child, as it would be impossible for me to kidnap what already belongs to me! There never was any missing persons report and never an Amber Alert," she added.

The singer battled drug addiction for years and she has attempted suicide multiple times. She appeared on season three of "Celebrity Rehab with Doctor Drew."

She was arrested in 2004 after trying to buy Oxycontin using a fake prescription in Tennessee. McCready plead guilty and she was ordered to pay $4,000 in fines as well as perform 200 hours of community service.

McCready rose to fame came when her song "Guys Do It All the Time" reached the number one spot on the Billboard Hot Country Singles and Tracks chart in 1996. She also had top 10 hits with "Ten Thousand Angels" and "A Girl's Gotta Do (What a Girl's Gotta Do)."
