Teens' Exposure to Christian Music Leads to Suspension, Lawsuit

A veteran youth counselor is suing a California children's home after she was suspended without pay because teenagers under her supervision overheard Christian music.

In a suit filed on Feb. 13, Maureen Loya charged Orangewood Children's Home with religious discrimination for slapping her with a six-week suspension for "exposing children to unapproved religious activities."

In July 2006, the counselor took four teenage girls from the Orangewood Children's Home on an approved field trip to the Anaheim 5K run and then to the beach.

When the group went to the Huntington Beach pier, they encountered the Surfrider Foundation's Celebrity Surf Jam, which featured a surfing competition and concert as part an effort to raise awareness and support for the nation's beach and coastal environments. Though the event's musical guests included secular artists such as Incubus and Peter DiStefano, Christian-based rock band Switchfoot was also in the mix.

According to the suit, the group overheard ten minutes of Christian music as they were eating. The girls also visited booths at the pier, some of which were selling Christian items.

Following the beach outing, Loya, who has worked with the group home for 18 years, was questioned about the trip during a disciplinary meeting at the children's home.

Several months later, the same incident was brought up again and the counselor received a letter notifying her of the suspension.

In February and March 2007, Loya served her six-week suspension without pay.

The recent suit, filed in the Orange County Superior Court, asks for compensation for the missed work time and to vindicate her constitutional rights.

Loya is represented by John and Laurie Messerly Stewart, attorneys in Orange, Calif., and the Pacific Justice Institute.

"What happened to this counselor was insane and unjust," said Brad Dacus, president of California-based Pacific Justice Institute. "Allowing teenagers to overhear a few minutes of Christian music while at the beach should not result in a six-week suspension."

The Orangewood Children's Home was created by the Orangewood Children's Foundation 25 years ago with a vision to build a facility to shelter Orange County children who were the victims of abuse, neglect and abandonment, according to the organization's Web site.

    Harry4Health, The Christian Post is currently using a third party advertising program much like google ads to service some of our ads.     H4H..couldn't agree more...A long time ago I was very lost and in a bad spiritual way...the mormons take full advantage of this state in a person...they grabbed me, had me baptised within 6 weeks and kept me so busy in their church activities I didnt have time to think. But it only lasted about 3 months then I started to question them...wrong...not allowed to do that...my childhood Catholic upbringing came back to me and I had more q's..all of which I got reprimanded for. I soon officially resigned from the mormons and so I was blackbanned and any friends I had made were forbidden to have anything to do with me. The mormons are on a par with islam...if you don't agree with them..watch out.
    So CPost...why do you advertise these false prophets on your site.
    As for the story,,,for goodness sakes.. the worker took them to the beach and they heard Christian music for 10 mins. Well excuse me!! How offended am I and many others when I have to put up with the call to prayer from the local mosque.??? And seeing Jesus our Saviour denigrated by muslims really makes me angry, why do you not cover stories of the persecution of Christians by muslims?
    BTW... a few years ago I went back to Jesus and asked His forgiveness. So now I know where I am in life and where I want to end up. And I belong to the True Church of Christ, which is NO denomination.

    I'm wondering- why is CHRISTIAN Post have an ad by the Mormon/LDS Church/the Church of Jesus Christ of Latter-day Saints, and below have an ad for a free Book of Mormon? The Mormon Church officially teaches that the Father, Son and Holy Ghost are "three Gods", there are many other Gods and goddesses, that we can become literal Gods and goddesses as God the Father- an exalted man of flesh and bones who lived on an earth like ours- BECAME A God with his exalted goddess wife, "our Heavenly Mother". They, together, are "our heavenly parents" (Ensign 3/2008, p 68, LDS Abraham 4-5, Doctrine and Covenants 132, LDS Melchizedek Priesthood study guide for 1985, Search These Commandments pp 151-158/Lesson 22, Gospel Principles, etc. ALL these are in context and official materials from the Mormon/LDS Church), that instead of salvation by grace through faith in the NT Jesus alone (Eph 2:1-9), teach that "We know that it is by grace that we are saved AFTER *all* we can do." (Book of Mormon 2 Nephi 25:23). Paul taught that grace and works cannot mix in Rom 11:6- "If it is by grace, then it is NO LONGER of works, otherwise grace is no more grace." It cannot be grace saves after all the works we can do. The Bible clearly teaches the only true God that exists is Yahweh (Isa 43-47, Deut 6:4, James 2:19). Two biblical tests of a true prophet is what he teaches about God (Deut 13), and if a claimed prophet has a perfect record of prophecy fulfillment (Duet 18). The Bible says that we should test even living apostles by already written scripture (Acts 17:11), not pray for a feeling/subjectivism (Book of Mormon Moroni 10:3-5, D&C 9). Gal 1:6-9, and 2 Cor 11:3-5,. 13-15 says that false gospels damn, and those who preach "ANOTHER [false] Jesus" and false gospels are false apostles, etc., and are "HIS [Satan's] ministers". Christians are to speak the truth in love (Eph 4:15), but this is the biblical truth. There is NO excuse for 'Christian' Post to allow these ads on their site.

    Does not the suspension depend on the individuals abiltiy to control what is going on in public? If someone was streaking down the sidewalk would she be suspended for taking the kids where someone else was streaking?

    hmmm, I think she deserves capital punishment for such crimes against humanity. Ok, that may be too strong, but the fact that they were minors should at least warrant life without parole. lol.

    I'd be interested in knowing what generated the concern, did one of the teens complain about it or simply share what they saw that day. If all that happened is in this article then this is just purely ridiculous. Plus, is the counselor even a Christian herself?

    No we're worried about what we might hear in happenchance. It was a public event that allowed Christian groups to perform and Christian vendors to sell. Plainly, there's more to this story. But to attribute Switchfoot to so much "noise pollution" borders on close-mindedness and bigotry.
