Andy Dick Sued Over Sexual Assault

Two men have filed a lawsuit suing Andy Dick for sexually assaulting them in a nightclub two years ago.

Tuesday, the attorney representing the two men from Kentucky said that the criminal case trial revolves around two counts of felony first-degree sexual abuse.

A 26-year-old from Ashland and 35-year-old from Catlettsburg claim that the comedian grabbed a bouncer's crotch, and groped, and kissed a patron while performing in several shows at a comedy club in Morgantown, W. Va.

Their attorney also said that the sexual abuse trial is scheduled to begin in Cabell County Circuit Court in Huntington, W. Va., on May 1.

Last summer Dick denied the sexual misconduct charges for the alleged behavior in Jan. 2010, pleading not guilty. Attorney Mike Woelfel said he filed the lawsuit earlier this month, seeking undisclosed damages, to comply with the statute of limitations which expired Monday.

"What I seek is a desire by the state and by the victims to assert that there is zero tolerance for sexual misconduct in whatever form it takes," said Woelfel, according to The Associated Press.

The lawsuit demands compensation for emotional distress, outrageous conduct, assault and invasion of privacy, and states that the two men were victims of "battery and sexual abuse."

Also, the complaint alleges that Dick "has a history of sexual misconduct which is serial in nature."

The comedian, of Pasadena, Calif., denies the charges. Dick's attorney Marc Williams has dismissed the accusations.

"This proves what we've known all along," said Williams, according to the Herald-Dispatch of Huntington. "This was only about getting money from a celebrity."

The 46-year-old comedian and actor is best known for his role on the television series "NewsRadio" in the 1990s. Legal entanglements for Dick also include substance abuse, and in 2008 he pleaded not guilty to misdemeanor charges of battery and possession of marijuana.
