'Making A Murderer' Season 2 Air Date, News: Steven Avery Denied A New Trial

The subject of the "Making a Murderer" documentary on Netflix is not getting a new trial. A judge denied Steven Avery and his lawyer Kathleen Zellner from presenting new test results and affidavits from additional witnesses in court.

Judge Angela Sutkiewicz ruled against Avery's request Tuesday and cited that the defendant and his lawyer failed to establish why his case warranted a new trial. There was no probability that the new evidence gathered for the defendant would bring a different result to his case, Sutkiewicz said.

In June, Avery's lawyer submitted a 1,272-page motion for a new trial. In it, Zellner stated that a man named Ryan Hillegas was the real culprit and that Avery was innocent.

Avery, 55, is in prison for the murder of Teresa Halbach in 2005. His nephew, Brendan Dassey, also remains in prison for confessing he helped his uncle.

The defendants insisted they are innocent of the crime, which has since become the core of the Netflix documentary. "Making a Murderer" cast doubts on the conviction and opened the idea that perhaps Avery and Dassey were victims of aframe-upp.

In August 2016, a judge overturned Dassey's sentence as the courts proved that the authorities forced the confession from a 16-year-old boy. Judges, however, have yet to reach a ruling as of this September and Dassey still cannot get out of prison while his case is on appeal.

Meanwhile, "Making a Murderer" filmmakers Laura Ricciardi and Moira Demos are following up on the latest on Avery and Dassey for the documentary's second season offering. Netflix announced the follow up in August 2016.

"Very few people inside of Netflix actually know the details of what we're getting because we're wanting to keep it really under wraps and it is an ongoing case so we're trying to be sensitive to that," Netflix Vice President Cindy Holland said.

Netflix has not announced the second season's release date but it might arrive later in the year.
