Tom Cruise and Katie Holmes are set to go through a turbulent divorce battle and the news has immediately sparked rumors over what settlement agreement they will come to.

According to various reports Cruise and Holmes signed a prenup when they were married in 2006, and Holmes will be able to claim $3 million for each year they were married. Their five years of marriage will mean she could claim $15 million.

That may seem like a huge amount to most Americans, but considering the divorcing couple have a combined worth of $275 million, Holmes is likely to seek more than that.

According to Hollywood Life, a top New York divorce attorney, Vikki Ziegler has said, "There will be some type of alimony or pay out of the assets…Generally speaking, celebrities have a clause for every year they are married. Even if she signed a prenup, she can say now that she was forced, or that it was unfair and try to fight it. She should fight it because's she's getting screwed if it's just three million per year."

Ziegler seems to think that Holmes could easily get more than the $15 million, and believes a wise divorce attorney would highlight the needs of six year old daughter Suri Cruise to ensure a higher payout from Tom Cruise.

Ziegler has said to Hollywood Life: "Most of the estate is Tom's. She'll have to go for a lot of child support. She'll have to show that Suri has nannies, cars, activities, clothes, hair appointments. That a hefty amount each month is needed to maintain Suri's lifestyle."

It has also been reported that Holmes has already made her intentions clear that she will fight for full custody of Suri. So child support would seem a reasonable prediction as one of the core fights likely to take place in the divorce battle.

However, Suri was born prior to the couple being married in 2006, and some suggest that would mean a provision could have already been implemented into the prenup agreement.

Tom Cruise will soon have been divorced for a third time; he was previously married to Nicole Kidman, with whom he had two children. Before that, he was married to Mimi Rogers, an actress, from 1987 to 1990.

For Holmes, 33, this was her first marriage. The wedding took place in November 2006 in a luxurious ceremony at an Italian castle.
