Conservatives Blast ENDA Bill for Restricting Religious Freedom

Conservative leaders are lamenting the recent passage of a bill that would make it illegal for Christian business owners to make employment decisions based on “sexual orientation.”

On Wednesday, the U.S. House of Representatives voted 235-184 to pass the Employment Non-discrimination Act (ENDA), a bill which adds “sexual orientation” to a list of federally protected classes under a 1964 act that prohibits job discrimination on the basis of race, color, religion, sex or national origin.

If the legislation makes it pass the Senate, it will likely be blocked as the White House has already indicated President Bush’s intention to veto the bill.

But the fact the bill made it pass the House has prompted an outcry from leaders of pro-family organizations who are adamantly urging a veto.

“This is a bad bill with bad consequences for our nation,” said Richard Land, president of the Southern Baptist Ethics & Religious Liberty Commission.

“I am extremely hopeful, if it were by some strange happenstance to pass the Senate, the president would follow through on his signals to veto this really bad bill,” added Land in a Baptist Press report.

Some of the reasons ERLC cited for opposing the bill included the establishment of rights for a category that does not rise to the level of unchangeable traits, such as race and gender. The group also contended that the measure would pave the way for the legalization of "same-sex marriage."

Matt Barber, a policy director for cultural issues at Concerned Women for America, said ENDA's supporters have “drawn a black line through the free exercise clause of the First Amendment.”

Sharing the concerns of many opponents of the bill, Barber said in a written release Thursday that the legislation would violate an employer’s free exercise of religion.

“ENDA would unconstitutionally force business owners to abandon their faith at the workplace door and adopt a view of sexual morality which runs directly counter to central tenets of every major world religion and thousands of years of history,” said Barber.

“It’s hard to imagine the Framers agreeing that newfangled ‘gay rights,’ based on changeable sexual behaviors, should trump the First Amendment,” he added.

CWA is calling upon its supporters to ask their senators to reject the bill while other pro-family groups such as Liberty Counsel have urged its constituents to ask the president to follow through with the veto.

“[W]e need to make sure there are enough votes to sustain that veto in the Senate, as we did in the House, should ENDA ultimately cross his desk,” Shari Rendall, CWA’s director of legislation and public policy, stated Thursday.

A two-thirds vote or greater is needed in both the House and the Senate to override the president's veto.

Republicans who spoke against the bill Wednesday claimed it would lead to an onslaught of questionable litigation. They said the enactment of the bill would also lead to situations where Christian employees could be forbidden to have Bibles at their desk since a co-worker might argue that presence of a religious symbol constitutes a hostile work environment.

"The so-called 'Employment Non-Discrimination Act' creates a legal quagmire for employees who practice, or even acknowledge, their religious beliefs — depending on where they happen to work, and subject to judicial interpretation," said House Republican Whip Roy Blunt of Missouri in a statement following the vote.

On Monday, many notable pro-family leaders sent a letter to all House members urging them to vote against the measure. Among the other 62 signers of that letter were representatives of Southern Baptist Ethics & Religious Liberty Commission. Focus on the Family, Family Research Council, Exodus International, Alliance Defense Fund, Concerned Women for America and American Family Association.

    there is only one " wolf in sheeps clothing" in this country, and that , my so called " christian" friends, is the babbling moron they call " el presidente George W BUSH " [ wolves are actually nice animals :) ] anyway , ENDA , the other one said what I would have , as to jim crow laws , but upon reading my unitarian universalist magazine's article about what the presidents REALLY INTENDED AS " SEPERATION OF CHURCH AND STATE " ; well thomas jefferson was simply a theist- he believed in god, but did not wish to use it to create this nation's laws[ by the way, he was on the side of the danbury,CT BAPTISTS whom did not want a national religion ! ] george washington also belived in god ; but he felt that " govt should be ROMAN STYLE while religion? personal ! " madison was a southern liberal, so this leaves the ONLY ONE of our four foundaing fathers of the constitution , PRES. ADAMS - whom wanted religion to be law like it was in both old england back then, and yes, IN NEW ENGLAND [ MA] where he came from. adams was a PURITAN and so, lost the american election to none other then thomas jefferson, I believe! and so, old " KING GEORGE W BUSH" is actually going against what this country was founded upon, by forcing teachers to teach our children " abstinence based sex ed " which does not work; as well as destroying women's right to a SAFE and legal, abortion! funny I was just reading my favorite FEMINIST lady's column , " below the belt" by none other then KIM GANDY OF the national org . for women ; and what she wrote about THE LIBERAL DEMOCRATS actually being more for family values! funny , for us liberal feminists and queers like myself; a transsexual woman legally female; moral values are based upon what we see in life! for many FUNDAMENTALIST " christians " ; they are based upon some book called THE TORAH [ " old testament " ] A BOOK MOST JEWS LONG SINCE DISCARDED ; and yes, the NEW TESTAMENT , written by PAUL not jesus[ and yes matthew,mark,luke, john ] why wasn't jesus TRUE FOLLOWER , the liberal-like jesus himself, THOMAS INCLUDED ???

    As a follow up, how about walking up to a female coworker and inquiring why she's wearing shoes, off her back, out of the kitchen and not pregnant and see how far you get? Isn't that impairing freedom of speech? Or how about a muslim getting enraged that a female coworker isn't wearing a burkah? Isn't that as offensive to them as working with a homosexual is to you people? Face it, until the US is turned into a Theocracy, akin to Iran, this country will continue to embrace freedom and the lifestyles of all our varied citizens (provided that their lifestyle doesn't adversely impact the lives of others or jeopardize public safety).

    Another example of the irrationality of the typical bible-thumping christian mind. The ENDA would do away with free speech and the practice of religion? Hardly. With regard to the free speech issue, any person may express his or her own point of view but that ability doesn't carry with it full immunity. Just as you may not utter threats against the president without ending up in trouble, fighting words or disparaging remarks obviously carry the risk of repercussions. There are enough torts between infliction of emotional distress and harassment beyond this new legal regime that such remarks would be ill advised in any case. Next on the issue of freedom to practice one's religion I hardly see how the presence of another person can serve to deprive an individual of his or her religious freedom. Just because you're bigoted and hate those who are different from you doesn't mean that their presence prevents you from observing your religion. Religion exists within our minds and hearts not in our surroundings. The repugnance you find in homosexuals doesn't give you the right to treat them differently than any other citizen. Should we bring back the Jim Crow laws of the segregated south? Better yet, how about we make the gays wear big pink patches on their clothes so we all know who they are and can stay away from them?

    'Prophet', yes, it can habve further effects, but if a non Christian hires a homosexual, and something against homosexual activity/sex is said, ythe same thing can happen. The same with Blacks, etc. If it is a Christian company (not just a Christian who owns a company, like a retail store, shop, marketing company, high tech, etc), then I think it is up to the owner. But if it is a company that isn't a ministry, etc., then that is different. I know the problem of free speech, etc., is there (just look at Canada & other countries). Your concern itself is valid.

    He is into guerilla tactics. He is a terrorist elite. He sneaks in as a wolf in sheeps clothing. He gets the government to pass a bill that is "somewhat threatening" to Christianity, but yet benign enough to hopefully pacify the average Christian. But they don't see the big picture of what is going on. Small steps to accomplish a big agenda. That old story about cooking frogs. You don't try to throw a frog into a pot of boiling water...he'll just keep hopping out. But put him in a pot of cold water and slowly turn the heat up. He'll never know that he's being cooked alive, until it's too late.

    Don't think it could happen? There have already been bills presented to congress trying to make it a hate crime to speak against homosexuality. Worse yet, this bill that ENDA is trying to pass, would mean that churches would no longer be able to refuse employment to a gay person based on their sexual orientation. Once again, if a homosexual gains employment at a church, he/she could cite that it is a hostile workplace and therefore control what is being taught and preached there.

    I agree with you, Harry. But what you don't see is the future. ENDA would not force owners to abandon their faith at the workplace....at first. What will most likely happen is that, say for example, a homosexual gets a job at a Christian company. Two other Christian employees are talking among themselves about their Biblical convictions about sin, including homosexuality. The homosexual person takes offense, claiming harassment, suing the company. i.e. free speech is done away with.

    Any nation who makes laws in favour of homosexuality should meditate about the fate of the ancient cities of Sodom, Gomorah, Admah, Zeboim and Zoar, perhaps making a trip to the Dead Sea in Middle East.

    Matt Barber, a CWA policy director, claims ENDA would force owners to abandon their faith at the workplace, but it isn't to abandon it at all, but to let those you disagree with have a job at their business. I don't see anything in the Bible to forbid Christians to employ same sex attracted people. Where is the line drawn, anyway? Fornicators? Prideful people? Those living together? Gluttons (boy, that biblically defined sin is under-mentioned in the church!), etc? The law isn't based on changeable behavior, but 'orientation'- the law says this, doesn't it? It's attractions, not actions. Will Christians employers have questions to interviewees on same sex attractions, and if they are acting on them? I am not writing this to defend ENDA, but to raise question a few weak points in what he says. It isn't good to attempt to defend a correct position with incorrect arguments.
