Pro-Family Groups Remain Wary Despite Justice Dept.'s DOMA Defense

Gay marriage advocates have accused the Obama administration of betrayal, pointing to the U.S. Justice Department's recent motion to dismiss a same-sex marriage case.

"Unfortunately, the malicious and outrageous arguments and language used in the Justice Department's brief [are] only serving to inflame and malign the humanity of same-sex couples and our families," said Rea Carey, executive director of the National Gay and Lesbian Task Force Action Fund, according to the Los Angeles Times.

Last Thursday, the Justice Department filed a motion to dismiss the Smelt v. United States case that challenges the federal Defense of Marriage Act. The motion argues that the plaintiffs, Arthur Smelt and Christopher Hammer, lack standing because they failed to allege that they have ever applied for federal benefits, let alone that they have been denied any as a result of DOMA. The gay married couple from California also did not attempt to have their marriage recognized in a different state.

The 1996 federal Defense of Marriage Act (DOMA), enacted under the Clinton administration, defines marriage as a legal union between one man and one woman for purposes of all federal laws, and provides that states need not recognize same-sex marriages from another state.

Gay activist John Aravosis denounces the Justice Department's argument as "gratuitously homophobic" and "as if it were written by one of George Bush's top political appointees."

"Obama didn't just argue a technicality about the case, he argued that DOMA is reasonable. That DOMA is constitutional. That DOMA wasn't motivated by any anti-gay animus," Aravosis states on Americablog.

Aravosis further decried the Justice Department's invoking incest and pedophilia in its arguments.

Although conservatives may be tempted to laud Obama for last week's brief, Randy Thomas, executive vice president of Exodus International, cautions against premature praise.

"The temptation for a social conservative is to say, 'way to go Obama!' and be deceived into thinking that he ultimately won’t redefine marriage, family, religious liberty and civil liberties/rights," said Thomas in his personal blog.

"I think we must remember that while the Obama justice department is seemingly repeating social conservative arguments … other Obama Administration departments are inculcating gay ideology into their corporate environments," he added.

Earlier this month, Obama declared June "Lesbian, Gay, Bisexual and Transgender Pride Month" and vowed to support measures to “bring the full spectrum of equal rights to LGBT Americans."

Obama also has appointed Kevin Jennings – founder of the Gay, Lesbian, and Straight Education Network – as assistant deputy secretary for the Office of Safe and Drug-Free Schools.

Pro-family groups are alerting its supporters that GLSEN is the chief national group promoting policies to force affirmation of homosexuality in schools, beginning in kindergarten. They have urged Obama to withdraw the appointment of Jennings.

Additionally, White House spokesman Shin Inouye told the LA Times that the brief submitted by the Justice Department last week was in following its normal practice of defending current law and that Obama "remains fully committed" to his proposals on gay rights, which include the repeal of DOMA.

"The president has said he wants to see a legislative repeal of the Defense of Marriage Act because it prevents LGBT (lesbian, gay, bisexual and transgender) couples from being granted equal rights and benefits," Inouye said.

Traditional marriage supporters have continued to rally support to oppose Obama's plan and are pushing for constitutional marriage amendments in each state to protect marriage as a union between a man and a woman.

    Boy yall, know how to fight an argument that has nothing to do with the article at hand, btw what happened is called smoke and mirrors. This is just another time where people want to control how everyone thinks and acts. I live in Virginia, we have a constituition and that constitution list marriage as between a man and a women. DOMA protects that and for someone in Massachusetts to control what the people do in virginia is true tyranny...

    Weekender, lying is a blatant sin (check out the 10 commandments, to start.) Ms. Prejean's job loss is in no way tied to her gay comment, and there is not a single shred of evidence or back that idea up. To insist that is untruthful, hence, you are lying and sinning. Purposefully sinning compromises your Christianity.

Next, you try to spin my words into saying I must not think Ms. Prejean is a Christian. Where on earth did I say that or give that impression? I haven't even said anything that would allow you to infer that, so it appears you're out for a witch hunt. How would I know Ms. Prejean's schedule and which appearances she made or did not make? I am going on the fact that multiple people, not just Mr. Trump, have said she has broken her contract repeatedly (such as making television appearances without the consent of the pageant.) It seems you're pretty desperate to believe her lies, and that's fine with me, but you have absolutely no ground to call me a liar or a fake.     Your bias is definitely in tact.

    I think if you were being just even a hint of non-bias, you'd be honest in saying that the Pageant claims contract violations. Miss Cal says no, so since neither are giving any specifics then we have to wait until specifics. When I ask you specifically, I mean which appearances were not okayed and which appearances were denied by Miss Cal. That's specific. She denies she has ever breaking the contract. Here again, do you not believe your sister in Christ over admitted heathen like Lewis and Trump - I find this interesting as well. You must think she's not a Christian. So since you don't know exactly the specifics, you are choosing to side with the non-believers. You do this repeatedly. You side with Hilton, who cussed out Miss California just because she gave an answer he didn't like. Name me a judge in a pageant that cussed out a contestant publicly for not answering a question according to the way they would like.

    That's why we don't respect you. You say one thing, yet you fight for non-believers. In other words, you're a fake and a liar.

    Weekender...where on earth would I find facts other than multiple media sources, both liberal and conservative, all reporting the same thing? Why are you denying that she was fired for blatant contract violations, because you want to pin this on the gay community.     Just because you say a contract violation occurred, or even that Fox News says one occurred, does not make it so. Earlier this evening I asked you for examples of the "many, many contract violations" you said occurred, yet you have yet to respond with facts -- but merely with links to websites that do not provide the facts you refuse to offer..

    You are obviously towing the liberal line without backing anything up with facts, as requested. The funny thing is, we're not surprised!! :)

    The weakest part of this whole effort on the part of the fundies and evangelistas is that their entire game plan is nothing more than ridiculous claims and religious based rhetoric which has nothing to do with secular laws.

    Compounding the problem for those sweating the Civil Rights arguments are those every same fundies and evangelistas since they know full well it is a Civil Rights issue and their ideology. A serious suggestion would be for those seeking to keep people from their rights take the time to read the law on the subject from knowledgeable writers (this would not include those like the yokel trial attorney who writes here from the list) as those folks have the breakdown accurately explained and not tainted by nonsense from pulpit puppets whose efforts aren't worth reading and certainly not worth any legal effectiveness.

    The only one spinning here is you. She very clearly violated her contract, and Trump said it was not about the pictures or the gay marriage comment, but with her continued refusal to follow their rules. It doesn't matter if its the Special Olympics or Larry King Live, if her contract says everything must be approved, then that's what she knowingly signed up for. If you'd rather believe a lie, go ahead, but its a shame you must compromise your "Christianity" to do so.

    This story links to Fox news. Y'all like them, right? Bascially, Ms. Prejean continually ignored her contract which stated she must clear any interviews or appearances through Trump's organization, which she repeatedly failed to do, despite various warnings all the way up to Mr. Trump himself. FYI, this was the very first story I found after Googling "Ms. California Title," so I find it very hard to believe not one news report you read said anything about this Rolln.

    I have a hunch that this will be just like the Miss California ordeal. Just when Miss Cal thought she had the ordeal behind her and honestly we were surprised that the liberals didn't win that battle, she gets fired.

    Much will be the same in this case. Obama leads us to believe he's all supportive of DOMA and we conservatives think we won a mini-battle, but one day we'll wake up the DOMA will be fired.
