3 things to know about the Austin mass shooting suspect, possible terror ties

2. Diagne hit a woman while driving a company vehicle in 2017; injuries caused severe disability

Diagne hit a pedestrian in Brooklyn, New York, while driving a company vehicle in January 2016, according to a lawsuit obtained by the New York Post.

The lawsuit, filed on May 25, 2017, alleged that Diagne’s vehicle “made contact” with the pedestrian, Jennifer Antoine, on Flatbush Avenue in 2016.

“Jennifer Antoine sustained severe and permanent personal injuries, became sick, sore, lame and disabled; suffered injuries to her nervous system; suffered mental anguish, was confined to hospital, bed and home and may, in the future, be so confined,” the lawsuit stated.

Due to the incident, Antoine was “incapacitated from attending to her usual duties and vocation” and may “suffer a loss and/or limitation of quality and enjoyment of life,” the suit claimed.

The suit also alleged that Diagne and the company that owned the vehicle, Hurricane Management Corp, were “negligent, careless, reckless, grossly negligent in the ownership, operation, management, maintenance, repair, inspection and control” of the vehicle.

While the lawsuit did not state the dollar amount sought by Antoine, the document said the “plaintiff is only seeking to recover those damages not recoverable through no-fault insurance under the facts and circumstances in this action.”

At the time of reporting, the resolution of the case is unknown.

The shooter worked as a cab driver at some point in the 2010s, the NY Post reported; however, his Taxi & Limousine Commission license expired in 2020, and it’s unclear whether the lawsuit was filed while he worked as a cab driver.

According to the Department of Homeland Security, Diagne initially entered the U.S. on a tourist visa in March 2000, and later became a lawful permanent resident after marrying a U.S. citizen in 2006. In 2016, he was living in the Bronx while working as a cab and rideshare driver.
