5. What might the Judiciary Committee have missed?

In a Fox News interview Monday, Sen. Lindsey Graham, R-South Carolina, said he believed the Republicans would not fall short of the votes and that Kavanaugh would be confirmed, adding that he thinks nothing new would be found from the in supplemental FBI investigation.

The South Carolina senator believes fellow Republican senators Lisa Murkowski of Alaska and Susan Collins of Maine, who are key votes and have not yet indicated how they will vote on Kavanaugh's nomination, "want to make sure that the FBI did their homework to check the committee's work, that our work was good. I think that's what this is all about."

CP asked Mukasey and Nunziata what the Judiciary Committee might have missed if indeed their work was not good, referring to Graham's stated concerns about the thinking of Murkowski and Collins.

Nunziata replied: "I don't know what those individual senators have in mind. I think some senators have indicated that they think that perhaps partisan committee investigators who don't have the experience of the FBI or the activity and they feel they would have more confidence in the FBI re-running some of the stuff that were run by committee staff."

"I don't think it's obvious that it provides additional value at this point. But it seems to be the case that some of the senators think so. And if they have more confidence in the process after that, then that's all to the good."
