4. Department of Education formally rescinds Biden-era Title IX rule

The U.S. Department of Education announced Monday that it rescinded a Biden administration rule that interpreted “sex” under Title IX of the Education Amendments of 1972 to include sexual orientation and gender identity, removing it from the Code of Federal Regulations.

Title IX requires recipients of federal funding to provide equal opportunities for women and girls in education, including in sports.

Multiple courts struck down the Biden-era regulations, and the last of the litigation over the rule concluded last month. That cleared the way for the Trump administration to formally restore the 2020 Title IX rules from Trump’s first term, which the department has enforced since the start of his second term.

“Today’s rulemaking clears the Biden Administration’s illegal rewrite of Title IX from the Code of Federal Regulations and restores the commonsense language promulgated in the first Trump Administration, which we have been enforcing since the first days of the Administration,” said U.S. Secretary of Education Linda McMahon. “Thanks to today’s action, the published Title IX regulations faithfully reflects court orders and Congressional intent—reducing confusion for parents, students, and educational institutions.”

McMahon vowed, “We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls.”
