6. Jane Doe’s text messages with those she later accused 

On Oct. 21, 2024, Jane Doe received a text message from one of the men she later accused of sexually assaulting her. 

“I just wanted to apologize for how things went down the other night,” he wrote, adding that he and another man that Jane Doe later accused of assaulting her felt bad for being under the influence of drugs and alcohol. He added that they both felt bad for failing to “shut it down and kick people out before it got way out of hand.”

Jane Doe replied, “At the end of the day non of the sexual stuff was illegal and honestly i really liked being w u and matt.”

In another text message on Oct. 23, 2024, Jane Doe wrote to one of the fraternity members she later accused of sexual assault that the episode was “RUINING [her] life temporarily” and that all she could do was “sleep and cry all day.”

The man she texted assured Jane Doe that everyone would soon forget what they heard, telling her that he did not have “anything to be ashamed of.” Jane Doe replied that he was right and that it would get better. 

In an exchange on Oct. 23, 2024, between Jane Doe and a man identified by the Tompkins County District Attorney's Office as Male Number 1, Jane Doe stated: "everyone needs to grow up cause sexuality and sex and s--- is changing and stuff like this is going to become more common, I'm also really open minded tho, I luv you king."

As Halloween approached, Chi Phi was preparing for a party that Jane Doe reportedly wanted to attend. Text messages between Jane Doe and one of the men she later accused show that the fraternity member assured her that he and the others wanted her there. 

Jane Doe replied, “thank u i really appreciate that, <3 i’ll bring my cigs tomorrow”

The fraternity’s president later disinvited Jane Doe from the Halloween party, prompting Jane Doe to send this message to the fraternity member who had assured her she was invited: 

“I knew this was going to happen,” she wrote. “The woman will always get the short end of the stick. Yall aren’t my friends. Yall are covering your asses.”

On Nov. 3, 2024, Jane Doe sent a message to one of the fraternity members, alleging that she was sexually assaulted at the fraternity house back in October. 

“[L]et’s be clear that 90% of what happened that night was not consensual. i was given more [ketamine] than i can remember,” she stated, adding, “and i know that i told u i felt uncomfortable and i didn’t know anyone in the room.”

Jane Doe also alleged that she could only remember doing ketamine off of his genitalia “in front of everyone like a sex doll/worker.”

The accuser later requested a rape kit on Nov. 7 at an Ithaca hospital before reporting the incident to the Cornell University Police Department the following day.

After Jane Doe reported the incident to campus police as a sexual assault, messages obtained by ABC News show that one of the fraternity members wrote in a group chat on Nov. 8, 2024: “F—. “Should I call [Jane Doe]?”

“Wait a bit for me and [Executive Board] to figure out what we’re doing cuz there are a couple of other things going on,” the fraternity’s president wrote. “When was the last time you spoke to [Jane Doe]?”

According to records reviewed by ABC News, one of Jane Doe’s friends told campus authorities the following May that fraternity members repeatedly contacted her after the alleged incident. 

“They tried to contact [her] almost every day after it happened to, I guess, keep them on her good side and keep her happy and not [get] upset about the situation,” the friend alleged.
