3. Trump administration finds San Jose State University violated Title IX by letting men in women’s sports

In a statement Wednesday, the U.S. Department of Education’s Office of Civil Rights announced that it had determined that San Jose State University violated Title IX of the Education Amendments of 1972, which prohibits institutions that receive federal funding from engaging in discrimination on the basis of sex in educational programs. 

The California-based institution of higher education has found itself in the news in recent years as a trans-identified male athlete has competed on the women’s volleyball team, prompting female athletes at competing universities to forfeit their matches against the school rather than compete against someone with innate biological advantages. 

The department’s determination comes nearly a year after the federal government agency launched an investigation into the school.

“SJSU caused significant harm to female athletes by allowing a male to compete on the women’s volleyball team — creating unfairness in competition, compromising safety, and denying women equal opportunities in athletics, including scholarships and playing time,” said Assistant Secretary for Civil Rights Kimberly Richey. 

“Even worse, when female athletes spoke out, SJSU retaliated — ignoring sex-discrimination claims while subjecting one female SJSU athlete to a Title IX complaint for allegedly ‘misgendering’ the male athlete competing on a women’s team. This is unacceptable,” she added. 

The Office of Civil Rights proposed a resolution to rectify the school’s ongoing violation of Title IX that includes SJSU issuing a statement declaring that biological sex is “unchangeable” and restoring to female athletes “all individual athletic records and titles misappropriated by male athletes competing in women’s categories.” 

The resolution also asks SJSU to issue an apology letter to all female athletes who competed on SJSU’s women’s indoor volleyball team from 2022 to 2024 and the beach volleyball team in 2023, as well as all female athletes on opposing teams who opted to forfeit rather than compete against a trans-identified male athlete.
