5. Transgender Bathroom Directive for Schools

In 2016, Obama issued a directive to schools stating that they must allow transgender students and faculty to use whatever bathrooms or locker rooms correspond with their preferred gender identity.

The directive offered a new interpretation of the federal Title IX requirements, defining the term "sex" as including gender identity.

"There is no room in our schools for discrimination of any kind, including discrimination against transgender students on the basis of their sex," stated U.S. Attorney General Loretta Lynch.

"This guidance gives administrators, teachers, and parents the tools they need to protect transgender students from peer harassment and to identify and address unjust school policies."

Several states have filed suit against the directive, with a federal judge putting a nationwide injunction against its enforcement.
